1. Introduction
1.1 These terms and conditions (“Terms”) govern all purchases from the website of Gaelic Memories Photography (“we”, “us”, “our”).
1.2 The website is operated by Stephen Baxter, trading as Gaelic Memories Photography, Clooncah, Carrowbehy, Castlerea, Co. Roscommon, F45 PY92, Ireland. Telephone: +353 (0)89 478 5622 (“Owner”).
1.3 By placing an order on this website, you agree to be bound by these Terms, our Privacy Notice and any other policies referenced on the website.
2. Our products
2.1 We sell fine art photographic prints, fine art canvases and the publication “Celtic Visions of Ireland” (together, the “Products”).
2.2 Every effort is made to display colours and finishes accurately, but variations may occur due to monitor settings, printing processes, and materials; such minor variations do not constitute defects.
2.3 All sizes are approximate and small deviations may occur due to print or canvas stretching processes.
3. Ordering process
3.1 You may place orders by following the checkout process on the website; your order is an offer to buy the Products.
3.2 We will confirm receipt of your order by email; this acknowledgement does not constitute acceptance.
3.3 A contract is formed only when we send you a further email confirming dispatch of the Products.
3.4 We reserve the right to refuse or cancel any order, for example where a Product is unavailable, an error in pricing has occurred, or fraud is suspected; in such cases any payment received will be refunded.
4. Prices, currency and payment
4.1 Prices are shown in euro (EUR) and include Irish VAT where applicable, unless stated otherwise.
4.2 Shipping charges and any applicable taxes or customs duties outside Ireland are displayed or estimated at checkout; you are responsible for any import duties, taxes or fees in your own country.
4.3 We may change prices at any time, but this will not affect orders already accepted.
4.4 Payment must be made at the time of order using the payment methods shown on the website; you confirm that you are authorised to use the chosen payment method.
5. Shipping and delivery
5.1 We ship from Ireland to customers worldwide, subject to carrier availability and local import restrictions.
5.2 Estimated delivery times and shipping options are shown during checkout; these are estimates only and not guaranteed.
5.3 Risk of loss or damage to the Products passes to you upon delivery to the delivery address provided, but ownership passes only when full payment is received.
5.4 If a parcel is returned to us due to incorrect or incomplete address supplied by you, we may charge additional shipping costs to resend.
6. International customers
6.1 You are responsible for ensuring that ordering and importing the Products is lawful in your country and complies with local regulations.
6.2 Customs inspections may delay delivery; we are not responsible for such delays or additional customs charges.
7. Right to cancel (EU/EEA consumers)
7.1 If you are a consumer residing in the EU or EEA and purchase Products online, you have a legal right to cancel the contract within 14 days without giving any reason, except where an exemption applies as set out below.
7.2 The cancellation period expires 14 days after the day you (or a third party indicated by you, other than the carrier) acquire physical possession of the Products.
7.3 To exercise the right to cancel, you must inform us of your decision to cancel by a clear statement (for example, a letter or email) using the contact details above before the cancellation period has expired.
7.4 If you cancel, we will reimburse all payments received from you, including standard delivery costs, without undue delay and not later than 14 days from the day we are informed of your decision to cancel.
7.5 We may withhold reimbursement until we have received the Products back or you have supplied evidence of having sent them back, whichever is earlier.
7.6 You must send back the Products without undue delay and in any event not later than 14 days from the day you communicated your cancellation; you bear the direct cost of returning the Products.
7.7 You are liable for any diminished value of the Products resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods (similar to handling in a shop).
8. Returns, refunds and damaged items
8.1 In addition to your statutory rights, we may offer additional return options as described on the website; where any conflict arises, your statutory rights prevail.
8.2 If a Product arrives damaged, defective or incorrect, you must notify us as soon as reasonably possible, ideally within 7 days of delivery, with photographs of the damage or issue.
8.3 Where we accept that the Product is damaged or defective, we will, at our discretion, repair, replace, or refund the Product and reasonable return shipping costs.
8.4 Because our fine art prints and canvases are usually produced to order, we reserve the right to refuse returns where the Product is not defective and has been correctly supplied, except where required by applicable law.
9. Product care and limitations
9.1 Fine art prints and canvases are delicate and should be displayed away from direct sunlight, moisture, and extreme temperatures to preserve longevity.
9.2 We are not liable for damage caused by improper handling, hanging, cleaning, or environmental conditions once Products have been delivered.
10. Intellectual property
10.1 All images, photographs, text and other content on the website and in the Products are the exclusive copyright of Stephen Baxter (Gaelic Memories Photography) unless otherwise stated.
10.2 Purchase of a Product grants you a personal right to own and display that physical copy only; it does not grant any licence to reproduce, copy, scan, distribute, or otherwise exploit the image commercially or non‑commercially.
10.3 You may not use our images or content in any advertising, marketing, online or printed media without our prior written permission and a separate licence agreement where applicable.
10.4 All trademarks, logos and trade names used on the website remain the property of their respective owners and may not be used without permission.
11. Use of the website
11.1 You agree not to misuse the website, including but not limited to: attempting unauthorised access, introducing viruses or malicious code, scraping or automated data collection, or interfering with the website’s operation.
11.2 We may suspend or terminate access to the website at any time if we reasonably believe you have breached these Terms or applicable law.
12. Privacy and data protection
12.1 Personal data collected during your use of the website and purchase of Products will be processed in accordance with our Privacy Notice and in compliance with the EU General Data Protection Regulation (GDPR) and applicable Irish data protection law.
12.2 We will use your personal data for purposes including order processing, delivery, customer service, legal compliance and, where you consent, marketing communications; you may withdraw consent at any time.
13. Liability
13.1 Nothing in these Terms limits or excludes our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.
13.2 Subject to clause 13.1, we shall not be liable for any indirect or consequential loss, loss of profit, loss of business, or loss of data arising out of or in connection with your use of the website or purchase of Products.
13.3 Our total liability in respect of any claim relating to a Product shall not exceed the price paid for that Product and associated standard delivery charges.
14. Events outside our control
14.1 We are not responsible for failure to perform or delay in performance of any of our obligations under a contract caused by events outside our reasonable control, including but not limited to natural disasters, war, strikes, pandemics, carrier or customs delays, or power or internet failures.
14.2 If such an event occurs, we will notify you as soon as reasonably possible and our obligations will be suspended for the duration of the event.
15. Changes to these Terms
15.1 We may update these Terms from time to time, for example to reflect changes in law, our business practices or Products offered.
15.2 The Terms in force at the time you place your order will apply to that order; archived versions can be provided on request.
16. Governing law and jurisdiction
16.1 These Terms and any contract between you and us are governed by the laws of Ireland, without prejudice to any mandatory consumer protections in your country of residence under EU law where applicable.
16.2 The courts of Ireland will have non‑exclusive jurisdiction to hear any disputes, meaning that consumers resident in the EU/EEA may also bring claims in their local courts as required by consumer protection rules.
